1. Scope and Contracting Party

These General Terms and Conditions, hereinafter referred to as “GTC”, apply to all orders that you place as a consumer via the online shop https://www.roesch-fashion.com.

A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.

2. Ordering Options

Orders for our goods can be placed exclusively via our online shop.

Orders by telephone, email or other communication channels are not accepted.

*The basic rates charged by your telecommunications provider apply. Rösch Fashion Shop does not charge any fees beyond the mere use of the telecommunications service.

4. Conclusion of Contract

The presentation of products in the Rösch Fashion Shop does not constitute a legally binding offer, but rather a non-binding online catalogue. You may initially place our products in the shopping cart without obligation and review and correct your entries at any time before submitting your binding order by using the correction tools provided and explained for this purpose during the ordering process.

To change the selected goods, you can correct the quantity of items or remove items from the shopping cart at the end of the ordering process in the order overview. By clicking the order button “order with obligation to pay”, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order is provided directly in the Rösch Fashion Shop and by email immediately after the order has been submitted. Subject to the following provision regarding conclusion of contract depending on the payment method, this does not yet constitute acceptance of the contract, but merely informs you that we have received your order.

The time at which the contract is concluded depends on the payment method selected:

• For the payment methods credit card, PayPal and Klarna instant bank transfer, the contract is concluded at the time when you complete the payment instruction to us by confirming the payment.
• For the other payment methods, such as Klarna invoice or Klarna instalment payment, we may accept your order after checking availability by sending an acceptance declaration in a separate email or by dispatching the goods within 5 working days.

In the event of delivery difficulties, Rösch Fashion Shop is entitled to reject the order in whole or in part. Within 2 working days after becoming aware of such circumstances, a corresponding notification will be sent by email. Any advance payments already made will of course be refunded without undue delay to the original payment method used.

If a contract has been concluded, Rösch Fashion Shop will send the customer a shipping confirmation when the goods are dispatched. If products from one and the same order are not listed in the shipping confirmation, Rösch Fashion Shop has no obligation to deliver them.

If payment has already been triggered during the ordering process, it will be refunded without undue delay via the original payment method used if the order is not accepted, for example due to lack of availability.

The language available for concluding the contract is German. You have the option to save and print your order immediately after submitting it. In addition, the contract text, including the GTC of Rösch Fashion Shop, will be sent to you in the shipping confirmation by email, which can also be printed.

For customers who have registered in the Rösch Fashion Shop, the contract text is stored by Rösch Fashion Shop after conclusion of the contract. For a period of three years after conclusion of the contract, you can view and print your orders under the “My Account” section.

5. Minimum Order Value

Orders may be placed from a total goods value of at least EUR 20.00 and up to a maximum of EUR 10,000.00.

6. Prices

The prices applicable to the items ordered in the Rösch Fashion Shop are exclusively the prices displayed in the shopping cart at the time you submit your purchase offer. Prices are stated in euros and include statutory VAT.

7. Delivery and Prices for Shipping and Packaging

In addition to the stated product prices, we charge shipping costs. The flat-rate shipping fee includes packaging, insurance and shipping. The exact amount can be found in the following paragraph.

Shipping terms for deliveries within Germany:

Within Germany, Rösch Fashion Shop ships with DHL. Delivery takes place within 2–4 working days after conclusion of the contract.

For shipping within Germany, we charge a flat-rate shipping fee of EUR 4.95. From an order value of EUR 149.00, delivery is free of charge.

Shipping terms for deliveries outside Germany:

Deliveries outside Germany are made with DHL. Delivery takes place within 5–7 working days after conclusion of the contract.

Shipping is available to the following EU countries: Belgium, Bulgaria, Denmark, Estonia, Finland, France, Greece, Ireland, Italy, Croatia, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Austria, Poland, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain, the Czech Republic, Hungary and Cyprus.

For shipping to Austria, we charge a flat-rate shipping fee of EUR 6.95.

For all other EU countries, we deliver at a flat-rate shipping fee of EUR 9.95.

Information on returns and the costs incurred can be found in the Cancellation Policy, Section 10, and in the voluntary right of return, Section 11.

8. Transport Damage

If goods are delivered with obvious transport damage, please complain about such defects to the delivery agent as soon as possible and contact us without undue delay. Failure to make a complaint or contact us has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, by doing so, you help us to assert our own claims against the carrier or transport insurer.

9. Payment

Payment for the goods is made at the customer’s choice:

• by Klarna invoice
• by PayPal
• by credit card, Visa or MasterCard
• by Klarna instant bank transfer
• by Klarna instalment payment

Please note that any bank fees charged by your financial institution, where applicable, are to be borne by you.

Payment by Klarna Invoice, Klarna Instant Bank Transfer, Klarna Instalment Payment

To make your payment via Klarna, select the desired Klarna payment option, invoice, instant bank transfer or instalment payment, in the payment section of the checkout process. After confirming the order, you will automatically be redirected, where applicable via our technical payment service provider Mollie B.V., to the payment service provider Klarna. There, personal data is entered for the purpose of identifying and assigning your purchase, either to your existing Klarna customer account or as a guest user. After completion of the payment process, you will receive confirmation from Klarna with all relevant payment details. Depending on the option selected, you will pay the amount immediately, in the case of Klarna instant bank transfer the charge is made immediately upon completion of the ordering process/conclusion of the contract, within 30 days or by instalment payment. Please follow the payment instructions contained in Klarna’s email. Klarna guarantees the highest security and data protection standards. For comprehensive information, please visit Klarna.

Payment by PayPal

You pay the invoice amount via the online provider PayPal. In principle, you must be registered there or register first, authenticate yourself with your login details and confirm the payment instruction to us, with the possible exception of guest access. Your PayPal account is charged immediately upon completion of the ordering process, conclusion of the contract. Further information is provided during the ordering process. When paying by PayPal, PayPal’s payment processing guidelines apply. Further information can be found at Paypal.

Payment by Credit Card

You provide us with the credit card type, credit card number and expiry date, as well as the name in which the credit card is issued. Your credit card account is charged immediately upon completion of the ordering process, conclusion of the contract, by our payment service provider Shopify Payments.

10. Statutory Right of Cancellation and Model Cancellation Form

Cancellation Policy

Right of Cancellation

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods, if you ordered one item or several items as part of a single order and the item or items are delivered in one single delivery,

or

from the day on which you, or a third party named by you who is not the carrier, took possession of the last item, if you ordered several items as part of a single order and the items are delivered separately.

To exercise your right of cancellation, you must inform us, Rösch Fashion GmbH & Co. KG, Schaffhausenstraße 101, 72072 Tübingen, Tel.: +49 (0)7071 153-499, Email: service@roesch-fashion.de, of your decision to cancel this contract by means of a clear statement, for example a letter sent by post or an email. You may use the attached model cancellation form for this purpose, although this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period expires.

Consequences of Cancellation

You must return or hand over the goods to us without undue delay and in any event no later than 30 days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the fourteen-day period has expired.

We offer you the free use of our returns portal. There you can create a return label for free return shipping.

If you cancel this contract, we will reimburse all payments received from you, including delivery costs, except for the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us, without undue delay and in any event no later than fourteen days from the day on which we receive notification of your cancellation of this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction; you will not be charged any fees for this reimbursement.

You will only be liable for any diminished value of the goods if this diminished value results from handling the goods in a way that was not necessary to check their condition, properties and functioning.

We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

11. Voluntary Right of Return up to 30 Days after Receipt of Goods

In addition to the statutory right of cancellation, we grant you a voluntary right of return for a total of 30 days from receipt of the goods. After expiry of the statutory cancellation period described in Section 10, you may return the delivered goods to us within a further period of 16 days, day 15 to day 30 after receipt of the goods. The following differing provisions apply to this period.

Within the scope of the voluntary right of return, the shipping costs originally paid for delivery of the goods to you will not be refunded. We will refund only the pure value of the returned items.

You bear the direct costs of returning the goods. If you use our returns portal, the return fees stated in Section 10, DE: EUR 2.95 / AT: EUR 6.95 / other EU countries: EUR 9.95, will apply and will be deducted from the refund amount.

For returns within Germany, we will cover the return fee for you if you select reimbursement as shop credit in the returns portal. However, the original shipping costs will not be refunded in this case either.

The goods must be returned to us complete, in their original condition and undamaged. Returns are excluded if the goods show signs of use that go beyond a mere inspection/testing of their condition, are recognisably due to use beyond this, and the goods no longer appear as new; in this case, return is excluded. Your statutory rights, in particular from cancellation, Section 10, and warranty, Section 12, remain unaffected.

12. Warranty Rights

The statutory liability for defects, warranty, applies to all goods.

If goods prove to be defective, you may, at your choice, request subsequent performance in the form of removal of the defect or delivery of a defect-free item. Rösch Fashion Shop may refuse the type of subsequent performance chosen if it is only possible at disproportionate cost. If subsequent performance fails or is unreasonable for you, you may withdraw from the contract, reduce the purchase price and/or claim damages in accordance with the statutory provisions.

Damage resulting from improper use or insufficient or incorrect care is excluded from the warranty.

Rösch Fashion Shop has unlimited liability for damages arising from injury to life, body or health based on an intentional or negligent breach of duty.

• The above liability conditions do not apply to claims based on damages caused by us, our legal representatives or vicarious agents:
• in the event of injury to life, body or health
• in the event of intentional or grossly negligent breach of duty or fraudulent concealment
• within the scope of a guarantee promise, where agreed
• to the extent that the scope of application of the German Product Liability Act is opened
• in the event of breach of material contractual obligations, the fulfilment of which is essential for the proper performance of the contract and on compliance with which you may regularly rely, cardinal obligations. In this case, however, the liability of Rösch Fashion Shop is limited to the foreseeable damage typical for the contract.

13. Retention of Title

The delivered goods, goods subject to retention of title, remain the property of Rösch Fashion Shop until full payment of the total claim arising from the respective order. The customer must treat the goods subject to retention of title with care.

In the event of seizure of the goods subject to retention of title by third parties or other interventions by third parties, the customer must point out the ownership of Rösch Fashion Shop and must notify us without undue delay in text form so that we can enforce our ownership rights.

14. Data Protection

Rösch Fashion Shop collects, processes and uses personal data to the extent necessary for processing orders and purchases. Further data is also collected, processed and used if you have previously expressly consented to this. Consent may be withdrawn at any time with effect for the future. Rösch Fashion Shop protects this data by means of appropriate technical and organisational measures in compliance with the General Data Protection Regulation, GDPR, the German Federal Data Protection Act, BDSG, and other applicable data protection provisions. Further information on data protection can be found in our Privacy Policy.

Rösch Fashion Shop discloses your personal data required for processing orders and purchases to third parties only to the extent that this is necessary for processing orders and purchases, for example for delivery by parcel services, where there is a legal obligation to disclose the data, or where you have previously consented to the transmission.

If you select payment methods provided by an external payment service provider during the ordering process, payment is processed directly via this provider. In this context, personal data may be transmitted to the respective payment service provider.

15. Presentation

The presentation of the products may differ in individual cases from the delivered goods. This applies in particular to minor deviations caused by technical factors. Rösch Fashion Shop always endeavours to present the items as faithfully and accurately as possible; however, minor colour deviations may occur, for example due to different screen settings. Such minor deviations caused by technical factors do not constitute a defect, provided they are reasonable for the customer.

16. Copyright

The rights of use, copyrights and other protective rights for all protectable content of the website, including texts, graphics, photos, images, moving images, sounds, illustrations and software, hereinafter referred to as “content”, are held by Rösch Fashion GmbH & Co. KG or the respectively named rights holders. Unless otherwise stated within the website or unless it is strictly necessary for use of the website offering, any use of the content without the prior express consent of the respective rights holder is not permitted. This applies in particular to reproduction, editing, translation, storage, processing and the use of image and text material on internet platforms or social networks.

17. Other Terms

The offer in our online shop is directed exclusively at consumers. By using the online offering of Rösch Fashion Shop, you accept these General Terms and Conditions in their respectively valid version. The contractual relationship is governed by the law of the Federal Republic of Germany, excluding the provisions of international sales law.

Notwithstanding this choice of law, all statutory provisions of a consumer’s home country that serve to protect consumers and from which no deviation may be made by agreement under the law of the customer’s home country remain applicable to this contract. The statutory place of jurisdiction applies to consumers.

The European Commission provides a platform for online dispute resolution, ODR, which you can find at https://ec.europa.eu/consumers/odr/. We endeavour to resolve any differences of opinion arising from our contract amicably. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

We have submitted to the quality criteria of Trusted Shops. These can be viewed at https://www.trustedshops.de. The statutory place of jurisdiction applies to consumers.
